Who Can File a Wrongful Death Lawsuit in Texas?
According to Chapter 71 of the Texas Civil Practice and Remedies Code, the following parties can file a wrongful death lawsuit on behalf of a loved one killed in an accident.

In Texas, the statute of limitations for wrongful death is two years. This means that you have two years after the date of your loved one’s passing (not the date when they sustained their injury) to file your wrongful death lawsuit.
