The Jones Act
The Jones Act is a federal law originally known as the Merchant Marine Act of 1920. The law is designed to protect offshore workers from the significant risks that exist while working offshore.
In the event of an injury, the Jones Act requires the worker’s employer to pay “Maintenance and Cure” benefits, which cover the worker’s medical expenses (cure) and provide them with a daily living allowance (maintenance) while they are recovering from their injuries,
In addition to “Maintenance and Cure” benefits, the Jones Act also entitles injured offshore workers to recover damages for their physical injuries (pain and suffering, mental anguish and physical impairment), as well as their financial losses (past and future medical expenses and lost wages).
